Why not answer? A “fraud on the court” allegation is particularly severe, even for a MAGA DOJ regularly called out for pretextual legal arguments, misleading factual statements, professional misconduct and even suggestions of contempt. Its silence is deafening.
Trump’s personal lawyers (who offered a terse answer) are in no position to opine on DOJ internal policies, have no access to internal client defense memos from the IRS, setting aside the takes-two-to-tango nature of “collusion.” DOJ was not ordered to answer, but spurned a plain invitation.
Add the telling failure of this MAGA DOJ to reply to a first-ever “fraud on the court” allegation. The court expressed interest in DOJ’s IRS defense memo and in possible violation of DOJ policies and in “collusion” (which takes two), all implicating DOJ. Yet no response.
It is worth reading, particularly as it lays out methods and remedies available to the court.
Late yesterday, the court posted the attached reply of the challenger judges on Trump and MAGA DOJ committing “fraud on the court” in their rotten slush fund/tax amnesty “settlement.” 🧵
